Attorney general says inmate cleared in rape-murder JOHN McCARTHY Associated Press COLUMBUS, Ohio - A man serving a life sentence for murder and rape prepared to be freed Thursday afternoon after prosecutors dropped all charges against him based on DNA evidence in the case that pointed to another suspect. "When my wife told me I was coming home today for good, I was just overwhelmed with joy and tears of joy. I was amazed it was so soon. I thought it was going to drag out," Clarence Elkins said in a telephone interview from the Mansfield Correctional Institution. DNA evidence showed that Elkins, 42, could not have committed the crimes, said Bill Canterbury, spokesman for the Summit County prosecutor's office, which tried the case in 1998. Elkins' release was scheduled for Thursday afternoon, said Andrea Dean, prisons system spokeswoman. His wife, Melinda, and two sons were en route to the prison. His wife, Melinda, said she had a simple message for her husband: "I said, 'Pack your bags, you're coming home baby.'" Elkins, who would not have been eligible for parole until 2054, was convicted in the 1998 rape and murder of his mother-in-law, Judith Johnson, 58, and the rape of her then 6-year-old granddaughter. The focus of the investigation has turned to Earl Gene Mann, 32, who had a relationship with a woman who lived near one of the victims, Canterbury said. Mann, who has not been officially linked to the crimes for which Elkins was convicted, is serving a seven-year sentence for raping three girls. However, he recently failed five polygraph tests about his role in the crimes, Canterbury said. Elkins helped secure the DNA sample by retrieving a cigarette butt used by Mann, a fellow inmate at the Mansfield Correctional Institution. Melinda Elkins got the news when she arrived at Attorney General Jim Petro's office for a news conference Thursday, she said. Petro has worked for months to secure Clarence Elkins' release. After watching this case on American Justice, I am very happy for the Elkins family due to the release of Clarence. Based on what I heard and saw, I believed that he was innocent from the very beginning. As a student currently studying the laws of this nation, I am very astonished by why first of all anyone can be prosecuted simply based on a person's testimony (n.b. that there were no physical evidence to link Clarence to the murder and rape) and secondly why the prosecutor kept pressing the insignificance of the dna when sodomy was a major act done in this case. I am once again glad that another innocent man has been freed and my only regret is that the years that was stolen from him cannot be recanted. | ||

Thanks for your you comments. I am up here in Canada. I have been following Elkin's case for nearly two years since I first heard about it and trying to raise money for him on my web site. As a student of law you might be interested in two similar rape cases where the jail time was not as long but the evidence was perjured rather than ignored. Alex Nichols of Kincardine. The evidence was from two other officers who in fact where there and had him under surveillance and knew I had not made this threat. Those reports and their evidence were withheld from the court by another Ontario Provincial Police Officer who perjured himself to jail me. I was jailed 4 months without bail, beaten up by jail guards in the vicious town of Walkerton Ontario where lies, breach of trust and cover-up lead to the deaths of children and others in the "Walkerton Tainted Water Scandal". That town and that whole area is a rat's nets of police and political corruption. It is in that area where the unarmed Native Dudley George was shot dead by absolutely vicious racist Provincial Police. His story is to be aired on CTV tonight @ 8:00p.m. Ontario Canada time. These Ontario Provincial Police are engaged in racism, brutality, perjury, killing, huge pyramid gambling schemes, theft, intimidation, coercion trumping up evidence, vandalism, illegal drugs, and more and our media treat them as "GODS" who can do no wrong until the evidence is so overwhelming and becomes know world-wide it can no longer be ignore as with Clarence Elkins. That is why the Dudley George Story "ONE DEAD INDIAN" is finally being told because of world pressure. The famous Stephen Truscotte @ 14 years old these blood thirsty bastards wanted to hang as an adult spent most of his life in jailed because of cover-up and coerced evidence until world pressure got him a hearing. He was from the same area. Now, I have been threatened to be killed for what I know about the police in Canada and corruption within our government; a police officer’s gun already pointed in my face and pushed toward traffic in another incident. If nothing is done to uncover this corruption I believe I will also be killed for standing up against corruption racism and huge billion dollar pyramid and Ponzi schemes with the only thing they leave you with. With respect to Dudley George. OPP officer Bill Sword who claims he was there that night, still, after the conviction of the OPP Officer who killed Dudley George, believes Dudley and the Indians got what they deserved. Cops like that don't change. Bill sword is the "secret" investigating officer of the huge pyramid fraud "Women Empowing Women" who is covering up these "WHITE" collar crimes of the politicians, police, and corrupt lawyers in Ontario. dave...... www.crimebustersnow.com | ||

I JUST WATCHED AMERICAN JUSTICE ON NOV.8,2006 AND I CRIED ABOUT THE CASE ON MR.ELKINS IT JUST DISCUSSES ME THAT OUR JUSTICE SYSTEM WHO IS SUPPOSE TO PROTECT US FAILED THIS MAN GREATLY I READ A SIMILAR STORY LIKE THIS ONE THE SYSTEM NEEDS TO PUT MORE TIME INTO CAREFULLY LOOKING FOR A PERSON THAN JUST TRYING TO WIN POINTS WITH THE PUBLIC AND AS FAR AS HIS TIME LOST AND FINANCIAL HARDSHIP FOR HIS FAMILY I READ IN ANOTHER CASE OF AN INNOCENT MAN THE STATE HAD TO PAY YEARS OF WASTED TIME THATS THE LEAST THEY COULD DO.
