The charges against Amway/Quixtar go to the very heart of the company's business practices and most other multi-level marketing (MLM) schemes' -that there is no retail "direct selling" opportunity, only an endless chain recruitment program. The suit also attacks Quixtar's infamous "tools" business as a second pyramid scheme perpetrated on new recruits.

The "tools" scheme was exposed in a 2004 special report on NBC Dateline. The suit names the kingpin operation of Bill Britt as a pyramid scheme. NBC Dateline revealed that many of the kingpins make most of their money from the "tools" scheme, not from Amway/Quixtar sales as they claim. The charges are brought by one of America's most prestigious law firms, Boies, Schiller and Flexner. David Boies represented Vice-President Al Gore in front of the US Supreme Court in the world famous case, Gore vs. Bush that contested the vote counting in Florida after the 2000 election. The other firm partnering with Boies, Schiller & Flexner in the suit is Gary, Williams, Parenti, Finney, Lewis, McManus, Watson, & Sperando, P.L.. in Stuart, Florida. An Administrative Law Judge in 1979 ruled that Amway could continue to operate in the US, based on Amway's claims that its business was primarily based on retail sales (sales by Amway sales people (IBOs) to actual end-user customers). Amway claimed that the business was not based on each salesperson making money off the investments of other salespersons in an endless chain. The Attorney General claimed that the defendants' "downline marketing scheme" constituted a "product-based pyramid scheme. "However, the Texas anti-pyramid law was written by the multi-level marketing industry and is cited in the Direct Selling Association as the standard for DSA member "ethics." The hallmark of the law is that it specifically does not require retail selling. Texas is, in fact, becoming a nexus and haven for MLM schemes due to its MLM-friendly statute.

The court settlement dodged the basic question of why BioPerformance would be considered a pyramid scheme, based on lack of retail sales, when many other Texas-based MLM schemes operate similarly and are not prosecuted. The future of the MLM BioPerformance is uncertain. In a January press release, the company stated: "We are extremely pleased to be putting behind us the action by the State of Texas. We also are very pleased with the test results obtained so far. Distributors may expect to resume marketing the product soon. In its agreement with the State of Texas, BioPerformance specifically denied any wrong-doing."

5. AMWAY FAILS TO MUZZLE WHISTLE BLOWER. A Pennsylvania, court has denied Quixtar (Amway) its claim that former Amway Emerald distributor and whistle-blower, Eric Scheibeler, must submit to Quixtar's infamous "binding arbitration" process.

Scheibeler has written a widely read book, merchants of Deception that details deception in the Quixtar recruitment program run by Quixtar "kingpins." See

The court ruling is a major defeat for Amway/Quixtar. Quixtar tried to force a distributor into Amway's own system of arbitration years after the distributor stopped working with the company. Quixtar appeared to believe it could prevent ex-distributors for the rest of their lives from ever speaking out.

Binding arbitration would have prevented Scheibeler (all other distributors) from free Speech, long after ending work as an Amway distributor. Amway/Quixtar claimed that Scheibeler had defamed the company. It wanted that charge decided within its own arbitration program, not in a regular court of law.

The Judge stated that Quixtar's arbitration process was "unconscionable." Consumers are faced with a "take it or leave it" proposition to agree to the arbitration when they sign up. Few could possibly know its full effects on their lives. The extreme efforts that Amway will go to silence Scheibeler raises the question of how many other former Amway distributors have borne their losses and "failure" in silence, fearing that Amway might legally harass them and financially ruin them with legal costs.

Gatordave, you'd have a lot more credibility if your linked to sources other than "pyramid scheme alert". Fitzpatrick makes up his own definitions, states things as fact that are false, and folk like you go quote him!

Amway, and Quixtar still entirely base their "scheme" on sales to "actual end user customers". What the FTC and numerous courts acknowledge, and Fitzpatrick chooses to ignore, is that if an IBO buys some pasta from Quixtar or Amway, and eats it himself, then he's an "actual end user customer". This is so obvious to most people that it astounds me that some folk don't seem to understand it.

Or *are* you Robert FitzPatrick? The last post seeems to indicate it.

What you do not seem to understand, "ibofightback," or you are attempting to fool the masses with, is that Amway’s "business model" is an unsustainable pyramid fraud; over 99% of the people who get involved in Amway loose. That is proven mathematically and through the actual disclosed "earnings" (net losses) of "distributors" (victims).

Ask yourself ...why is Amway upset with proposed new regulations that would force them to disclose the "earnings" (losses) of their distributors if they are doing so well? Amway acknowledges this would seriously hurt their business. Why would disclosing millionaires, and others who they claim have obtained this “Financial Freedom”, and brag about no less, possibly hurt their “corporate image?” The simple proven answer is; it is all a pack of lies; they don’t exist; a pack of lies just like USANA and just like the Direct Seller’s Association (DSA) promoting pyramid fraud.

Like so many other criminals and criminal organizations and government registered corporations engaging in money-laundering racketeering, their criminal activities have simply been ignored and overlooked for years.

Now, Robert Fitzpatrick is an expert witness. He has testified in many court cases involving pyramid fraud schemes. He was in Sri Lanka assisting the bank and government in writing laws against pyramid fraud. He has appeared in all the major news media in the U.S. and the CBC in Canada. gatordave, you're doing the classic "straw man" setup that FtizPatrick does. Wildly complain about the problems of pyramid schemes and wildly complain about Amway as if they are the same thing, without actually backing up the claim.

99% of people who get involved in Amway *do not lose*. That's a myth. A significant percentage of folk who join Amway do so to get cheaper products, something acknowledged by the court in FTC vs Amway. Do the get Amway products cheaper by joining? Absolutely. Where's the loss?

Of the rest, the majority don't do the work required! Indeed, my data indicates that only about 1% of folk do the work necessary for the time required to build a successful Amway business. Are you saying it's fraudulent because it requires hard work to succeed and some people decide it's too hard? And they've got up to 12 months to get all their money back (depends on the country, always at least 3 months).

But then, why should I be surprised, given you think someone has credibility because they've been on TV and their photo is on the internet! He's been an expert witness! I quote from wikipedia -

Mmmhmmm. Myth: 70% Retail Sales Rule addresses just one of the issues where FitzPatrick is either clueless or dishonest.

Now that statement, (using your own words) certaily exposes a “significant number of folk” not purchasing at the touted retail prices. So how are the serious retail sales people supposed to make their suggested retail income against this unfair competition? And if anyone can join for an insignificant payment of a “start-up fee” and then buy products wholesale, why would anyone who buys even a few hundred dollars worth of these products continue to do so at retail if a simple one time small fee can supply a “life time” of products at below retail? That is unfair competition as well as fraudulent misrepresentation of the markup profit supposedly enjoyed by retail distributors. I receive many complaints from “distributors” two of whom lost their homes, even a distant relative whose concern was, that after selling hundreds of dollars of products to the neighbour, the neighbour, not informed of this small fee “up front” that would have saved hundreds of dollars, was irate! Some “retail distributors” reluctantly and retroactively refunded the difference. This situation is a direct result of this “business’s (pyramid fraud scheme) and misleading representation; the whole shaky foundation upon which it is built.

Then you ask this misleading “straw-man question” Where's the loss? The answer is simple; the loss is to the retail sales person who is mislead into believing in the “high retail markup rates” that supposedly will lead her/him to “financial freedom” with cars, houses, yachts, private planes etc.

Then you ask this “straw-man” question…. “Are you saying it's fraudulent because it requires hard work to succeed”…. Answer … absolutely not. What I’m saying is that notwithstanding all the hard work it is possible to expend in this fraudulent pyramid ”business” the vast majority of people promised “the dream” can never possibly achieve the dream. It is a physical and mathematical impossibility!

Then you ask this question…. “the actual courts that finally judge these things are all wrong!” [?] Answer… No. But the best un-anonymous debater on this forum, Bruce Audley, insisted for years, and is still, I believe, holding to his position that the “network marketing” company Treasure Traders International is a “perfectly legal” enterprise because they have a product; albeit a fraudulently appraised emerald. However, where the arguments counts in the country I live in – Canada; the judge of the Superior Court ruled that notwithstanding this “junk” TTI, is in fact a prima facie, illegal recruiting pyramid fraud.

Now, that decision is a result of being sued by two “network marketing” corporations, TTI and BIM for $10 million dollars allegedly for defamatory liable. They tried to have my website shut down by “injunctive relief” and an order preventing me from further defaming them. I successfully defended myself against these two corporations and their firm of 24 lawyers and after a careful five month deliberation the judge ruled they were, in fact, "prima facie" in violation of the Criminal Code of Canada and the Federal Competition Act. cont...

Unlike Bruce Audley you are anonymous. We do not know who you are or what you are. You could be a corrupt cop, a politician, a disgusting corrupt lawyer, accountant or just a simple self aggrandizing know-it-all or sadly a “brain-washed” victim. But the question I have for you is this… Have you, after preparing your own material and arguments personally won any decision in any superior court for or against any “legally registered” but criminal organization the decision from which you could post here?

We can argue for years “black is white and white is no colour at all.” I can say 2x2=4 and you can insist it = 5. Like the argument with Bruce Audley and his gang of supporters and all the apparent “information” from his friends in the Attorney’s General’s department. What ultimately matters, ”ibofightback”, in the game of law as you pointed out, is the court ruling where, as I have said before, one judge “trumps” a full house of corrupt lawyers, (including those in the high office of government) accountants and fraud artists”…. sort of like ENRON & WORLDCOM etc. proved.

So here’s the deal ”ibofightback”. From here in Canada Amway is a fraudulent criminal recruiting pyramid chain in violation of Sec 206 [1][e] of the Criminal Code. The people running this organization are engaged in a criminal act of fraudulent misrepresentation, “money laundering and racketeering.” That is fact! Now, in addition to that, I will plead “no contest” to any amount of damages anyone wishes to claim. No one need prove defamation or damages. So, sue me like the crooks of TTI and BIM have attempted to do. This would cost “peanuts” for the billion dollar likes of Amway or even a dollar or two from all these distributors you claim are doing so well in this corrupt organization. Within a couple of weeks Amway with its billions, or you distributors could be in front of an Ontario judge with all the high-priced lawyers your illegally gotten gains can buy, asking for an injunction restraining me from these defamatory comments.

If you don’t want to do that, in order to get a judge’s ruling in your favor, then really you are nothing more than an anonymous “voice from the underworld” with absolutely no credibility, simply trying to discredit those who are upfront and open willing to put their names, and, like the recently assassinated Ottawa Ontario “whistleblower” Randy Rankin, who played a clown for kids, their lives on the line to expose graft, corruption, money-laundering and racketeering. If you can’t bring yourself to sue for principal to fight back, how can you, with a straight face “bill” yourself as ”ibofightback?”

Personally, "ibofightback" would by crazy to step out from anonymity because the shear level of cyber-bullying you heap on anyone with an opposing opinion, simply is not worth it. Fortunately for some of us myself included, we easily see you for the angry, abusive, bully that you have become. Sticks and stones Dave, sticks and stones! Now, Conrad Black has been convicted. The Toronto Star last week finally, and it appears reluctantly, wrote a story about the "questionable" fundraising in a number of high profile charities - World-Vision, Sick Kids, that for years I have been openly complaining about and exposing. However they still refuse to name or discuss the reprehensible FOR PROFIT telemaketing companies behind "badge organizations" fraudulent fundraising; the likes of Great West Entertainmant now Xentel (Calgary & Florida) under Mike Platts in trouble with one state after another paying millions in fines resulting from fraudulently raising money for the police and other "badgeclubs" and associations, currentently raising funds for the Association of Fire Chiefs, Big Brothers, Shrine Circus even, unbelievably, CRIMESTOPPERS that recently and deliberately diseminated false information to the media regarding a trumped up "crime" (a lie) ... and this (omitted in the Star) the host of others and in the past, and perhaps even still, chapters of the Kinsmen's Club etc.

The Ontario Police Association itself using Millenium Telesevices in West Virginia with their fraud of "sending kids fishing with cops" 84.5% going to the corrupt U.S. telemarketers and most of the rest to the police association and on and on it goes.

And Amway is facing a class-action lawsuit along with USANA and others. Now, I would believe FitzPatrick long before before anyone aligned with the vicious Audley cyber-bulling gang.

Lie about the facts and the truth simply because you don't like the person notwithstanding the lies he is trying to uncover could cause great harm to seniors, the financially unsophisticated and students even in high school or even those unjustly facing jail.

It is obvious, you Audley, belong to the community type who perfere "sugar coated lies" and lots of "la-de-da" viz the raw truth.

I think any reasonable reader can see through a group of "scavaging sharks" with nothing better to do than rip apart a person already victimized by the flaws in the system that many of the same sharks, including you Audley ironically actually admit exist. Again readers, you see the horrendous truth ignored in favour of attacks on the "messinger." I have been extremely busy the last month or more. Students are returning to school where a concentrated effort is being made to recruit them into these scams and schemes. As I have said before; Interpol and other world organizations see this as an enormous exponentially exploding global problem.

Money-laundering white-collar crime has caught up to, an now quickly surpassing the entire global illicit drug trade. But then I doubt that drug trafficking disturbs "pickled_sausage" any more than these crimes.

Now that we've closed down the Sum-It Club and sent the "Legal Weasel" Lawyer, Tony Gagliese and his reprehensible intimidating lying sister, Rocchina Maimone, "underground" with hopefully the authorities moving in; and the young paralegal determined to get justice for these students those crooks "ripped off"; despite having been called about midnight the other night and told "Watch who you f**k with", she and CrimeBustersNow, nonetheless are in the process of taking down yet another reprehensibe crook, the "Pigeon King"; a particularly vile Ponzi scheme advertizing on radio and placing large ads in newspapers and magazines, operating from Waterloo Ontario.

This scam involves 10's, probably 100's of millions. When this illegal Ponzi scheme collapses, the devastation in the agricultural community, particularly the Mennonite community will be catastrophic.

I put this out for other readers. It's obvious "pickled-sausage"; a pyramid pushing sympathizer, like so many others with him, has little concern for the students, and in this case farmers, that are being defrauded and their lives irreparably damaged.

You go ahead and stuff your face with ribs, "pickled sausage", in oblivious, self imposed ignorance, and "who cares" attitude as to what is happening to our society.

At least Steven Truscott has finally been acquitted after 48 years. Of course it was people with your ignorance and attitude stirring the pot while at the same time closing your mind to obvious evidence then "brainwashing" others by vilifying him that would, no doubt, have had him hanged when he was fourteen, thereby avoiding all this controversy and truth searching.
