Wollersheim demands full refund and all back pay. What are YOU waiting for!

(Introductory note: I have asked Factnet to create a new section on the Factnet web site dedicated to posting all refund and back pay demand letters and to keep running totals of amounts. From my understanding of the IRS agreement and what other information sources I have access to, former and current Scientologists currently have maximum leverage from now until December 31, 1998 in getting all their money back. This is because of the Scientology's secret agreement with the IRS to pay all requested refunds and back pay requests as a condition of getting their final tax exemption OK. Yes, Scientoilogy will start a campaign to dead agent this information, but I am not waiting to make my demand. I have seen enough to feel an obligation to inform all X Scientologists "now is the refund and back pay time."

I most strongly recommend you do not delay another day in making your written demand on Scientology and posting it on the net (and send a copy to manage@factnet.org for our web site). I am sure many of you could use this money to help repair your lives from the Scientology experience. I further request that you contact everyone in your network of former members and have them contact everyone in their networks too. With all the criminal prosecution Scientology will soon be facing and the IRS lock, this is, in high probability the last best chance you will ever get to get made whole again from all the wasted time and money you "donated" for Scientology's fixed fee services.

I have been privately telling some of you about this information over the last 60 days. If you have already made your money demand privately (as quite a few of you have done) I also ask that you make it public so that others are also encouraged to stand up and demand their money)

Public Legal Notice to All Churches of Scientology, David Miscavige their Managing agent and its legal agents.

This is to notify you that I am demanding full repayment within 30 days of all donations that I ever paid to any church of Scientology or Scientology related corporation, approximately $93,700 . I was given an unconditional money back guarantee at the time I made these fixed fee donations I was guaranteed that if I ever wanted a refund all I had to do was ask for it and I would promptly receive it. I am demanding you fulfill the promise upon which the fixed donation services were sold to me.

My reason for requesting this refund is the services you sold me did not deliver the promised results, they were based on fraud and deception, they were based on dangerous covert hypnosis techniques that cost me in a lot therapy and related recovery costs, and because that is my legal right.

For several years I worked as a course and auditing sales person in Scientology and was specifically trained to tell anyone and everyone that they could always get their fixed donations back if Scientology did not deliver the results it was promising to them and if they were reluctant to buy the fixed donation service. This agreement did not have a list of conditions for return that were ever presented or disclosed to the fixed donor. The understanding and claim made to the donor was simply, if your weren't happy with the result you could get all of your money/donation back. There was no time limitation disclosed when we made this sales claim to others when I was a staff member or when I received this claim from others when I "donated" for fixed fee services.

In your new policy directive of 13 March 1996 called Return of Donations, you attempt to change your refund policy for the future and rewrite your history for the past. This is not possible.

I doubt even now, at the time you make your money back guarantee donation return claims you fully disclose and let the person read this new policy. Your new policy change to try to limit your IRS liability still does not free you from the laws of the country relating to fraud in selling services for a fixed donation. Consequently, all public and staff who purchased any fixed donation services after 1996 still have the right guaranteed by the state against fraud. Furthermore another reason I believe you published this new policy is because you are suffering from a rapidly rising number of refund requests and this is but another new effort on your part to further obstruct the lawful return of fixed donations when donors discover they have been conned.

You have promised the IRS in your secret agreements that as a condition of maintaining your non profit status, that you would immediately return all fixed donations for which refunds were requested. You further promised the IRS that as an additional condition of maintaining your non profit status that you not violate any fair labor laws and would pay the proper minimum wages and would resolve any claims for past minimum wages not paid. It is now time to make good on those promises.

I am further demanding that within 30 days I receive full minimum wage for all of the over 10,000 hours I worked as a Scientology staff member over the period from 1971-1979. This amount is $51,600 dollars less the slave labor wages you paid me while I worked there.

If I do not receive all of the money I am demanding and justly due within 30 days I will:

  1. Take this information to the Commissioner of the IRS asking the IRS to intervene to one get you to follow the law, your financial agreements to your customers and to the IRS for granting you tax exempt status.
  2. I will go to the Workers Compensation board of the state of California and begin an action to enforce the collection of all my back wages plus full penalties for failure to comply with California minimum wage law.
  3. I wIll further inform the California workers compensation department of your policies and actions of failing to report staff injuries and falsifying records relating to those matters.
  4. I will go to the California Medicare and State assistance boards and begin an action against your regarding your policy of defrauding Medicare and State social assistance of millions of dollars in medical and other assistance for Scientology staff members who were told to lie about who they were in order to defraud the State and federal government. On this issues I will disclose how I was coerced and ordered by Scientology executives to get my wife to lie about her Scientology employment and injuries while working on staff. This resulted in the State of California paying approximately $70,000 in medical costs that Scientology's Workers compensation and insurance companies should have paid. I believe this is a serious felony.

Furthermore, I will not be intimidated into signing any of your ridiculous releases that say I have no other claims of any type with your organization nor will I agree to any secrecy. The only release I will give you at the time of payment is just for the specific return of all donations and payment of all back wages.

Since it is organizational policy to refuse all registered or certified letters and to deny you received this notice by public mail, I have chosen to make it a public notice in a forum in which your agents are continuously present and copying posted materials.

Finally, I will not tolerate any refund don't have the records or other "games" and I will not delay one hour past this 30 day notice to act with the full force of the law and the awareness that massive public media attention can bring to this situation.

I am also sending this demand to your organizations and your other Legal agents.
