Scientology's vindictive religious persecution forces Gerry Armstrong to flee the US

Part 1

Gerry Armstrong and his Scientology reform church has had to flee the US because of Scientology's relentess religious persecution both through covert operations and the perverse twisting of secular law for religious persecution purposes.

The Gerry Armstrong story is another of the many ongoing examples of Scientology being the most active religious persecutor in the US. Scientology's actions against Gerry reflect their continious actions against many religious reformers and reform churches and beg the careful reconsideration of the following questions:

1. Can a non-profit religious organization that is given special state protected religious freedom and other special state sanctioned religious sanctuary class and tax privileges and protections, use the state^Òs secular for-profit business laws to carry out a religious agenda that creates a type of state "sanctioned" religious persecution?

2. Were secular for-profit business, trade secret, trademark or copyright laws ever intended or designed (under any stretch of the imagination or intention of the creators of these laws,) to:

a. inhibit religious freedom,

b. help one church establish a state "sanctioned" monopoly over competitive churches,

c. help enforce a state "sanctioned" religious authority, orthodoxy and purity,

d. help enforce a state "sanctioned" form of religious censorship,

e. help enforce a secular type of state "sanctioned" "religious" punishment of apostates,

f. become a state "sanctioned" force to crush fledgling religious reform groups, or

g. help favor one religion over another?

3. Should proven religious persecution practices by a state established religion be cause for the immediate removal of its U.S. IRS religious based non-profit tax status?

4. Is there a point where the many legitimate and valid uses for-profit business trade secret, trademark and copyright laws can be twisted to a point that they become improper or illegal. And, is that point when it becomes apparent that the intent behind enforcing these laws acts to deny the senior constitutionally protected rights and protections expressed in (a-g) above?

The Settlement Agreement Violates Freedom of Religion

Scientology (Scn) claims to be a religion, and claims all the extraordinary benefits conferred by the Constitution on religions. It claims that it is organized solely for religious purposes and that its policies and bulletins are "scriptures." (SS 138-143, CT 8522-4; revised by- laws, CT 7746, 7748,9)

It is axiomatic that there is no freedom of religion where there is no freedom to criticize, oppose or reform religion. The US was founded in great part by people fleeing "religious persecution" for opposing, criticizing or seeking to reform a religion which had the power, often provided by the State, to persecute them. The US recognized the need for its citizens to be free from religious persecution in the Religious Expression and Religious Establishment Clauses in the First Amendment to the Constitution.

Religious expression in the US has traditionally only been limited by an overriding State interest or need; e.g., to maintain peace, safety or morality. It is not permitted to destroy a fellow citizen as an expression of one's religion. It is not permitted religious expression to yell "hell fire" in a crowded theater. It is not permitted to enter private property, to wiretap, to steal, or to commit fraud, although called for in one's religious "scriptures."

The prohibition against the State's establishment of a religion has traditionally been interpreted to mean that no religion will be favored or given more support by government than any other religion. Christianity and Christians, Buddhism and Buddhists, and Scientology and Scientologists will be treated by government and all its branches in every way equally. Also anti- christians, anti-buddhists and anti-scientologists will be treated in every way equally.

With its Settlement agreement (SA) Scientology is attempting to suppress and eliminate criticism; as well as opposition and reformation efforts. Any court's enforcement of Scientology^Òs SA necessarily involves the State in one religion's suppression and elimination of criticism. Judicial enforcement also results in the promotion and establishment of Scn by the removal of opposition to promotion and establishment. Unless the State is also willing to become involved in and support every other religion's suppression or elimination of criticism, it may not assist Scn in its campaign.

It is, however, inconceivable that any US Court would prosecute someone who under any circumstances signed a contract which required that he not discuss God, Jesus Christ, the Holy Bible, or his experiences in the Christian religion; or for that matter Allah, Islam, Mohammed, the Koran, the Vedas, Krishna, or Xenu. Scn must learn that no Court will or may prosecute someone for breaking one of its unholy contracts which requires that he not discuss L. Ron Hubbard, Scn, Scientologists, Scn scriptures and the person's experiences in that religion.

It is inconceivable that a Christian church in the US would do what Scn has done to silence its critics. But even Christianity, although it would never silence anyone about itself, must not be given the opportunity. Therefore Scn's efforts to silence its critics and prevent discussion of itself must not be given judicial support. Its SAs must be ruled to be judicially unenforceable.

The acceptance of criticism, opposition and calls for reform must be the natural balance to the extraordinary benefits conferred on religions. Scn chose to call itself a religion, and, when it did so, in this country, it also had to accept its critics' freedom to criticize it without State intervention.

Scn's SA impermissibly creates a religious discrimination by prohibiting GA from assisting anyone adverse to its, a religion's, interests. If such a contractual, and now judicially enforced, prohibition of help is legal along religious lines, it could be equally as legal along racial lines, or political, or sexual. But no court would consider enforcing a contract which required non- assistance to Chinese people, Conservatives, or women. No court should also consider enforcing Scn's contract.

It is abundantly clear in the reading of the complete record (and GA prays that this Court will take the time to do so) that GA has believed throughout this litigation in the existence of God. (See, e.g., GA 6/21/91 letter, CT 7482-98) It clear that he has come to believe that his being involved in this case, and indeed all of his persecution by Scn, is for God's Purpose. (See, e.g., SS 146-156, CT 8525-39; 5894-923) It is also clear that he sees fair game as a terrible evil, and sees Scn's SAs and their enforcement as part of that evil.

The Holy Bible is certainly clear that God is intimately involved with man, religion and justice. He sends His prophets to decry injustice. The Court cannot say that GA is not guided by God. If GA had done something to disturb the peace or threaten public safety, the State can act against him. But here there is no question of peace, safety or morality; there is only a person speaking out to decry injustice, to decry what he sees as a real threat to peace, safety and morality. There is only a person speaking his thoughts. No US Court can say these are not God's thoughts. GA's words are religious expression about a religion, and they must be left completely free of State control.

By the direction of God or not this Court has the opportunity to do a great work and eliminate a great evil. It is great not because GA is great, but because the freedom of every person to freely express his conscience, freely tell the truth and freely help any of his fellows is great.

I am speaking now as an individual and only about my personal case in Denver involving Scientology. For 17 years I personally have been the continuous target of Scientology^Òs religious persecution. In my personal case in Denver I will be clearly and overwhelmingly demonstrating to the court that there are vital freedom of religion and separation of Church and state constitutional issues at stake in Scientology's perverse twisting of secular laws for religious persecution.

I have a passion for these issues beyond anything that I have done or felt in the secular issues involving Scientology at Factnet. I have already engaged in requesting Amicus curae briefs from other religious organizations and religious and secular lobbies. I believe Scientology is in for a fight and exposure on these issues beyond anything it currently faces or has faced (except for the criminal exposure surround the forged Hubbard signatures and the circumstances surrounding the death of L Ron Hubbard.)

I am certain that Scientology in new documents and declarations will be shown to the court and the world to be the US's worst religious persecutor in part because it is a shameless religion doing this religious persecution. I am currently personally uniting with other individuals and organizations that have a religious interest in stopping Scientology's religious persecution and for part of religious freedom work I will need your help.

Please create a declaration/Amicus Curae brief similar to the following and or modified to your truth and experience. These briefs will be used as follows, they will be shared with any other case against Scientology in addition to my personal case that requests them (i.e. the Armstrong Appeal or the Erlick cases.) They will be submitted to the US justice department for investigation into Scientology and its agent's systematic conspiracy to deny religious freedom and engage in religious persecution. They will be forwarded to the US State department for their next report on religious persecution around the world as well as other foreign governments that are investigating Scientology^Òs abuses.

Scientology is a religion that has gone mad in its massive systematic conspiracy to deprive others of their religious freedom and in its engaging in all forms or religious persecution against reformers and reform churches. For spiritual reasons these outrageous Scientology activities must be stopped cold in their tracks.

The only way that Scientology will ever stop its religious persecution is when it is punished by losing its copyrights and trade secrets for its use of them for religious persecution. Please help stop the religious persecution by using the following to create your declaration/Amicus Curae brief.

AFFIDAVIT/Or Amicus Curae brief

I am (was) a Scientologist (or I represent ________ organization.) I believe that Scientology and its legal agents are systematically conspiring to deny individuals their religious freedom and conspiring to religiously persecute reformers and reform churches and religious competitors.

I believe that the following legal issues should carefully be considered in regards to Scientology's religious persecution practices:

1. Can a non-profit religious organization that is given special state protected religious freedom and other special state sanctioned religious sanctuary class and tax privileges and protections, use the state^Òs secular for-profit business law to carry out a religious agenda that creates a type of state "sanctioned" religious persecution?

2. Were secular for-profit business trade secret, trademark and copyright laws ever intended or designed (under any stretch of the imagination or intention of the creators of these laws,) to:

a. inhibit religious freedom, b. help one church establish a state "sanctioned" monopoly over competitive churches, c. help enforce a state "sanctioned" religious authority, orthodoxy and purity, d. help enforce a state "sanctioned" form of religious censorship, e. help enforce a secular type of state "sanctioned" "religious" punishment of apostates, f. become a state "sanctioned" force to crush fledgling religious reform groups, or g. help favor one religion over another?

3. Should proven religious persecution practices by a state established religion be cause for the immediate removal of its U.S. IRS religious based non-profit tax status?

4. Is there a point where the many legitimate and valid uses for-profit business trade secret, trademark and copyright laws can be twisted to a point that they become improper or illegal. And, is that point when it becomes apparent that the intent behind enforcing these laws acts to deny the senior constitutionally protected rights and protections expressed in (a-g) above?

5. Has Scientology and its legal agents also engaged in a systematic conspiracy of covert operations to deny adversaries, former members and religious reformers their religious freedom and persecute them for their religious opposition or beliefs regarding Scientology?
