Has Scientology made more desperation telltale mistakes in the FACTNet case?
Has Scientology pissed off the court royally with its new Summary Judgment filing? You make the call...Judge Kane clearly stated he does not believe this case will be solved by summary judgement yet Scientology jams another summary judgment motion in his face. He also has warned about burying the court and the case in reams of paper. Then Judge Abram warned against any motion over ten pages will not be welcome.
What does Scientology do? They file a 36 page summary judgment motion with about 10 bankers boxes full of exhibits. Thats about 120,000- 140,000 pages.
Then to top it off they don't even serve it correctly on all the attornies of record. They only give the local counsel the exhibits. Denying 3 other lawfirms that are doing the bulk of the summary reply on this motion no exhibits and only the 36 page motion.
In a premediated action of extreeme bad faith and, after asking the court to dismiss their trade secret claims because they were trying to save everyone litigation costs (after the Lerma runing became final) Scientology now expects us to bear the cost of copying almost 500,000 pages plus shiping cost to two out of state attorneys for what they are required to do in their filings is simply outraegous.
This is but another small minded and malicious action of theirs that highlights their obstructionist scorched earth litigation tactics and their desire to make it impossible for us to respond in the allocated 20 days.
Well, FACTNet has some surprises coming very shortly, but until then they are on public notice until they hear from the court that:
They have not properly filed and served their summary motion on ALL Factnet attornies of record and until they do so we shall treat their filing as improperly served and not proper or active.
